Commission Breakdown

1. Availability In general, space is limited and is on a first come first serve basis and if commission is accepted a notice will be sent out when there are additional openings.
2. Hours Official business hours are subject to change depending on commission queues and etc. Generally, we respond to inquiries within two (2) business days. Normal hours are Monday, Tuesday, Wednesday, Thursday, and Friday from 12 pm to 9 pm CST. Please note that if commissions are not being worked on, we are designing new products to add to the store or working on personal projects (reference journal for artists, stock, etc). This schedule allows us to take breaks and not be overwhelmed. This also limits health complications from repetitive movements (carpal tunnel/arthritis) or sitting for too long. 3. Waitlist We may offer a limited wait list if there is interest. Payment would be due in full after the agreed upon scope of project. Each commission project is for one (1) item only (ie animal portrait etc). The exception would be the text-only based product(s). We will disregard the one (1) item rule for commissions if there currently were no other commission requests. We would provide a document showing the current queue status. We would also send you an email or text message when project is began. We would not withdraw your funds from PayPal until the work is complete.
4. Confirmation of Acceptance (both parties) You cannot change what you want your commission to be after approving the project scope and sending payment. We may accept up to two (2) minor edits (depending on project) at the end. If you exceed more than two (2) minor edits, we will charge $25+ per edit as an extra fee (if we accept the change). That does not include taxes or other fees. Immediate payment of those charges would be due before continuing and/or doing the requested changes. Please remember that you accept the scope of work, terms, understand the commission process and make payment before work even begins.
5. Cancellation & Declined Commission We reserve the right to decline a commission (before payment) for any reason and without harassment. An example would be if we felt that we would not be the best artist for the project or there was a time restraint that we would not be able to meet. We would attempt to refer you to an artist that specializes in your request when possible. We WILL cancel commissions for undue harassment or frequent change requests. We discuss and agree upon your project before starting and payment receipt. You confirm that you read and accept our terms and other relevant information.
6. Rights as Artist We retain all rights to our work, which include but are not limited to the right to use the artwork for self-promotion, as a sample print product in the store (ie leave in commission pickup collection), and/or upload it to websites, social media, or portfolio (unless otherwise agreed upon). If you would like to keep the commission private, please let us know before the start of your project. At that point, we will make sure the finished work is not posted publicly anywhere. We can also refer to you anonymously if you want to allow us to post the artwork without using your actual name. If you would like us to post after a certain date, please let us know. Disclaimer: We do not claim ownership of any personal reference photos or your business branding.
7. Payments They are completed on Etsy, printify, squarespace or other third parties. We normally would use a custom PayPal invoice generated specifically for your project. Payments should be paid in full before work is started. It should be paid within 24 hours (1 business day) of both parties accepting the agreed upon price, timeline, project etc. If it is not paid in full and we have not heard anything from you, we move to the next customer and you will lose your place in the queue. You can contact us again to get back in the queue. The cost is in USD only. The base price does not reflect any taxes, service charges etc that may be charged by the payment merchant, online store(s) etc. The price is for the commission only. We will automatically add your commission on a magnet and canvas or keychain free of charge to the store. The cost of you purchasing any extra merchandise from the store with your commission on it is a separate “as is” price and is uploaded for your convenience.
8. Refunds If payment was made and you cancel before work is started, we will refund 75% of the original price. Please note that the amount you may receive may potentially be lower due to any taxes or merchant fees that were taken out. If work was started or completed and you want to cancel, we retain all rights to progress artwork. You are not provided any sketches or finished artwork. If work is completed we do not provide a refund. You would receive the finished work. If the commission is in progress (i.e. more than halfway done), you may get a 25-50% refund. Please note that you will not receive the unfinished artwork or any sketches. This limits scam artists trying to get free work done without paying. This is also why full payment is due up front and in full before work is started. It is also the reason why in most cases, sketches are not provided for animal portraits. Sketches or layouts are provided for some graphic design projects. Our art style is in the portfolio section. Your digital art is generally a loose sketch (clear lines) and semi-detailed watercolor style. We are not a hyperrealist artist and some colors are not exact. We do our best to stay within realistic coloring. We are unable to recreate every single physical identification (ie all 327 dots on your Dalmatian's nose). If a customer harasses us for no reason or repeatedly asks for changes or other demands after the agreed upon commission project parameters, we may cancel the commission. The artwork will remain our own. There will be documentation of said harassment. In rare instances that there is an unforeseen circumstance (ie computer dying, health reasons etc) and the customer does not want to wait until the issue is resolved (within that three (3) week maximum time period), we will happily refund the full amount (minus any pay merchant/transaction fees etc) and let customer know when we are up and running again in case they would like to start the project over. In these cases, we may offer a discount for the inconvenience. Please note that we do not anticipate any such instance of having to cancel due to the above reason(s). In most instances, commissions are completed within 7 - 15 business days. Business days are considered Monday, Tuesday, Wednesday, Thursday, and Fridays from 12 noon until 9 pm. Depending on our current workload or reference provided, a commission can on average be completed within three (3) business days or so. Please let us know if you are looking for a rush job (it may reflect a higher cost).
9. Stock and References It is better that there are at least three (3) high quality/large sized images submitted by email. Lighting must be well lit and show details. If possible, the best references are those at eye level of the animal or pet (ie not towering over a chihuahua). In the event that this is not possible, please understand that we will do what we can within reason. Please be as detailed as possible with your request. If we have to source references (instead of the customer providing their own), we retain rights due to it being either originally purchased by us or the customer paid the stock fee(s) for us to use with the correct license (ie istockphoto etc). For detailed information about different license fees for stock, you would have to view the terms on the stock providers website. If you want us to use a particular stock (ie istockphoto etc), you must provide payment for the stock AND the correct license type (with addition of commission cost) before we can start the project. References provided by the customer must be their own and not copyrighted. If the customer just wants a render of a particular animal, we normally already have stock that we can reference. Please note there may be previous or future renditions of the same subject, reference, or pose from that reference.
10. Business Requests If you are a legitimate business, we must have in writing from your official business email (with business website extension) that you give express permission for us to use your provided logo or brand identity to edit, alter, or put on merchandise. We would not own the copyright to any of the businesses' brands, copyright or trademark. If we feel that you are not affiliated with the business, we reserve the right to not accept your commission.
11. Timeline Crystal Hubbard (Art) is the sole artist and LLC operator. Estimated completion time is generally no longer than three (3) weeks (max)/15 business days. That time frame may be longer if it was agreed upon beforehand due to a complicated piece. We only work on one (1) commission at a time. Work is normally completed within a few days but we add the extra deadline time in case of unexpected emergencies such as Covid etc. The three (3) week (max) completion timer begins when your project is started. This does not include accepting your commission/payment. The timer begins when we let you know that you are next in the queue (by email and/or text). The current queue is discussed before payment. You will have access to a spreadsheet that shows the current status of all of commission projects (ie amount of commissions before yours). Please notify us before payment if you need a rush job to make sure it can be completed before the deadline. Payment holds your spot in line for one (1) commission. The exception would be the text-only based product(s). We will disregard the one (1) item rule for commissions if there currently are no other commission requests.
12. Tips and Payments Thank you for your support. The option is available for those who want to show appreciation and support. It is not mandatory. It is through PayPal. You may want to ensure that there are no auto tip renewal options auto selected after you tip (i.e. weekly/monthly/yearly). We have no control over any extra fees or features. Tips and Payments
13. Usage (Commercial & Personal) Contact us for commercial pricing (i.e. if you intend to make prints, use on book covers, or have any intention to make money with the finished product). Commercial usage reflects a higher cost. For personal use, do not claim it as your own. Do not use the final product to make any monetary gain. That would be commercial use and would reflect higher pricing and a different contract. Do not claim any finished artwork as your own. We may allow you the right to make prints etc for your own personal usage as an alternative. This would be if you do not want to use our print on demand service providers. Do not use our work to make money due to that would require the commercial license agreement and would reflect a higher cost. If you are fundraising for a non-profit, religious entity, family or school function, Crystal Hubbard Art LLC gives permission for you to resell with the understanding that we still retain original copyright (if it is original art). If it is a business logo or of a photo added to items for a memorial etc, please disregard. Do not make your own version based on our work. Our legal time will contact you. Please let us know before accepting the fee/paying invoice/accepting terms if you require the finished product for something other than personal usage. Commercial usage would get a larger digital size. You may NOT use the finished artwork for any sort of NFTs/Blockchain/Cryptocurrency. Additionally, you may NOT use the artwork for training AI. You have the right to use your commission for any personal use such as your avatars, wallpapers, icons, profile pictures, upload it to your own personal galleries with credit given, etc as long as it is not for commercial use or you claim you created the artwork. Do not use Crystal Hubbard Art for mass/bulk print on demand (POD) services unless we specifically designate you as a merchandising provider. An example would be using free or purchased Crystal Hubbard Art products in mass bulk with the intention to sell in stores, nationwide, at a function etc (an example would be purchasing regional Detroit items in bulk to sell in an airport giftshop). This would be considered commercial usage and would require approval, compensation and a written agreement before purchase. If you are a business or entity (ie graphic design firm, news outlet etc) please contact Crystal Hubbard Art to discuss commercial usage (compensation and agreement) for potential use in your project.
14. WIP Updates Please note that not every project receives WIP (work in progress updates). Please understand that if a WIP had to be done with every project and every little aspect was shared, it would lengthen turnaround times for finished projects and increase pricing. Everything should be discussed before finalizing commission specifications or making payment for work to be started. This is regarding a digital sketch or painting of an animal.
